Privacy Policy

We at Osaka Gas Energy Supply and Trading Pte. Ltd. (“OGEST”) are committed to protecting our stakeholders’ and customers’ personal data in accordance with the Personal Data Protection Act 2012 (the “PDPA”) and other applicable data protection laws, to the extent that OGEST is subject to those laws.


This Privacy Policy (“Policy”) describes how we collect, use and/or disclose the personal data you have provided to us, as well as informing you on your rights under the PDPA.


1    INTRODUCTION 

 

1.1    “Personal Data” means any data about an individual who can be identified from that data, as more specifically defined in the PDPA and other appliable data protection laws. 

 

1.2    By interacting with us and accessing our website, you agree to OGEST collecting, using and/or disclosing your personal data in accordance with this Policy. 

 

1.3    We may from time to time update this Policy to ensure it is consistent with future developments and/or any changes in legal or regulatory requirements. Please check regularly for updated information. 


2    PURPOSES FOR COLLECTION, USE & DISCLOSURE OF PERSONAL DATA

2.1    Generally, OGEST collects, uses and discloses your personal data for the following purposes:

​

(a)    facilitating, processing, managing and/or maintaining your relationship with us; 
(b)    carrying out due diligence or other screening activities (including background checks) in accordance with legal or regulatory obligations or risk management procedures that may be required by law or that may have been put in place by us;
(c)    carrying out your instructions or responding to any enquiries by you;
(d)    dealing in any matters relating to the services and/or products offered by us; 
(e)    investigating fraud, misconduct, any unlawful action or omission, whether relating to your relationship with us or any other matter arising from your relationship with us, and whether or not there is any suspicion of the aforementioned; 
(f)    storing, hosting, backing up (whether for disaster recovery or otherwise) of your personal data, whether within or outside Singapore; 
(g)    management of threats to safety and security (including but not limited to OGEST’s premises, services, IT and network security); and
(h)    complying with applicable law in administering and managing your relationship with OGEST,

 

(collectively, the “Purposes”).

 

As the purposes for which we may/will collect, use, disclose or process your personal data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose at the time of obtaining your consent, unless collecting, using, disclosing or processing of your personal data without your consent is permitted by the PDPA or by other applicable law.

 

2.2    In order to conduct our business operations more smoothly, we may also be disclosing the personal data you have provided to us to our third party service providers, agents and/or our affiliates or related corporations, which may be sited outside of Singapore, for one or more of the above-stated Purposes. This is because such third party service providers, agents and/or affiliates or related corporations would be processing your personal data on our behalf for one or more of the above-stated Purposes. If we transfer your personal data to countries outside Singapore, it will be done in accordance with the relevant provisions under Singapore laws and regulations.

3    REQUEST FOR ACCESS AND/OR CORRECTION OF PERSONAL DATA

 

3.1    You may request to access and/or correct the personal data currently in our possession at any time by emailing your request to ogest-legal@ogest.com.sg

 

3.2    For a request to access personal data, we will provide you with the relevant personal data within a reasonable time from such a request being made.

 

3.3    For a request to correct personal data, we will correct your personal data as soon as practicable after the request has been made and after verification of such amendments. 

 

3.4    Depending on the nature of the work required to process your access request, we may be required to charge you a reasonable fee for the handling and processing of your requests to access your personal data to recover administrative costs. Our Data Protection Officer will determine whether such a fee should be imposed on a case-by-case basis. Where such a fee is to be imposed, we shall provide you with a written estimate of the fee for your consideration. We shall only begin processing your access request upon receiving your agreement to the payment of the fee.

 

4    REQUEST TO WITHDRAW CONSENT

4.1    You may withdraw your consent for the collection, use and/or disclosure of your personal data in our possession at any time by emailing your request to ogest-legal@ogest.com.sg.

 

4.2    We will process your request within a reasonable time from such a request for withdrawal of consent being made, and will thereafter refrain from collecting, using and/or disclosing your personal data in the manner stated in your request. Please note that withdrawal of consent for OGEST to collect, use and/or disclose personal information means that we will stop these activities and may cause us to be unable to continue providing products and services to you. 


5    ADMINISTRATION AND MANAGEMENT OF PERSONAL DATA


5.1    We will take commercially reasonable efforts to ensure that appropriate physical and electronic controls are in place to protect your personal data. Appropriate security arrangements will be taken to prevent any unauthorized access, collection, use, disclosure, copying, modification, leakage, loss, damage and/or alteration of your personal data. However, we cannot assume responsibility for any unauthorized use of your personal data by third parties which are wholly attributable to factors beyond our control. 

 

5.2    OGEST shall retain your personal data for as long as is necessary for the Purposes stated in Section 2.1 above, and take reasonable measures to destroy any personal data that is no longer necessary to meet those purposes.
